Pfizer Says China Used Wrong Standards In Overturning Viagra Patent

Law360, New York (May 18, 2005, 12:00 AM EDT) -- China overturned the patent for erectile dysfunction drug Viagra after applying the wrong standards retroactively, according to Pfizer Inc. vice-chairman Jeffrey Kindler.

“Our concern is not with the fact that the patent was challenged, but with the standards that were applied,” Kindler told members of the media while visiting Beijing.

He said the standards used by government officials in this case were inconsistent with Chinese law and international treaties, yet were applied retroactively to a patent first filed several years before.
