Hess Can't Drown Water Pollution Claims In Superfund Case

Law360, New York (June 4, 2012, 7:36 PM EDT) -- A federal judge on Monday refused to let Hess Oil Virgin Islands Corp. escape claims in a Superfund suit in the U.S. Virgin Islands over alleged water pollution from its oil refinery, finding the company cannot claim ownership of the groundwater beneath the facility.

U.S. District Judge Harvey Bartle III denied the company's partial motion for summary judgment covering government recovery efforts for groundwater pollution under the facility, leaving Hess and its subsidiary Hovensa LLC to face allegations of strict liability for an abnormally dangerous activity,...
