Rethinking The Unemployment Status Of Job Applicants

Law360, New York (July 19, 2012, 1:09 PM EDT) -- In 2011, President Barack Obama proposed a federal jobs package to incentivize businesses to hire more workers. Since the passage of the American Jobs Act last year, there have been additional legislative efforts on both the federal and state levels to provide protection for unemployed job applicants.

For example, on the federal level, the U.S. Equal Employment Opportunity Commission has heightened its scrutiny of all pre-employment screening practices, including the use of criminal background checks, credit checks and unemployment status as screening tools.
