Merck Wins Dismissal Of Vioxx False Claims Suit From MDL

Law360, Los Angeles (June 14, 2012, 6:46 PM EDT) -- A Louisiana federal judge on Wednesday dismissed a Washington, D.C., resident's false claims allegations in multidistrict litigation over the painkiller Vioxx, ruling the Medicaid recipient lacked standing to sue drugmaker Merck & Co.

Judge Eldon E. Fallon dismissed a claim brought by Kenneth Walker under D.C. Consumer Protection Procedures Act, because he didn't allege that the Vioxx he consumed was either ineffective or caused him physical injury. Walker's original lawsuit against Merck was filed under seal in August 2005.
