EU High Court Gives Car Cos. Leeway In Picking Dealers

Law360, New York (June 14, 2012, 9:22 PM EDT) -- A European High Court on Thursday handed a win to Tata Motor Ltd.’s Jaguar Land Rover, ruling that automakers did not have to publish or uniformly apply the criteria they used to choose dealers for their distribution networks.

The European Court of Justice ruled that an auto manufacturer with a quantitative distribution network — one that limits the number of authorized dealers in a specific territory — only had to have verifiable criteria to fall under antitrust law exemptions.
