FERC Considers Rival Plan For 500-MW Colo. Hydro Project

Law360, New York (June 14, 2012, 9:39 PM EDT) -- The Federal Energy Regulatory Commission on Wednesday began soliciting comments on a proposal from a Colorado water district challenging Washington-based Inca Engineers Inc. for the right to build a 500-megawatt hydroelectric plant on Plateau Creek.

Over the past six months, the parties have filed virtually identical applications for preliminary approval from FERC, but unlike Inca, the Dolores Water Conservancy District claims it already owns the water rights at the desired project site, according to a notice the commission published Wednesday in the Federal Register.
