Abbott Shoots Down Government Complaint

Law360 (September 18, 2007, 12:00 AM EDT) -- Abbott Laboratories has called for the dismissal of the U.S. government’s case in the average wholesale price litigation that alleges the pharmaceutical company inflated its prices to scam Medicare and boost sales.

Abbott sought to throw out the government’s first amended complaint in the U.S. District Court for the District of Massachusetts on Monday – the same day it demanded that the government produce evidence regarding the differences between published average wholesale prices and provider acquisition costs.
