EU Unveils Dispute Mechanism For Foreign Investors

Law360, New York (June 21, 2012, 2:45 PM EDT) -- The European Commission on Thursday proposed a new rule intended to provide security to foreign investors in European Union states by creating a method to determine whether the financial responsibility for a dispute lies with the EU or the country.

The proposal is part of a broad investment policy, which the commission said had become its exclusive competence under the Lisbon Treaty, and is meant to ensure that foreign investors in the EU are not affected by the division of responsibility.
