Kaiser Tells DC Circ. It's Owed More Medicare Reimbursement

Law360, New York (June 25, 2012, 2:11 PM EDT) -- Kaiser Foundation Hospitals, a nonprofit serving the West Coast, told the D.C. Circuit on Thursday that it is entitled to additional Medicare reimbursement because of botched estimates of its staffing levels in the 1990s, an argument federal officials say comes too late.

At issue are payments made by Medicare for salaries given to graduate medical program staffers, such as interns and residents. Reimbursement is calculated based on the number of staffers, and Congress years ago said staffing levels used for determining payment can’t exceed levels in...
