AG Set For Trial In Dam Rent Suit Against Utilities

Law360, New York (September 19, 2007, 12:00 AM EDT) -- Montana's claim that utilities should pay rent for running hydroelectric dams on state land has been bolstered by recent pretrial decisions in which the state judge ruled against the companies, the state attorney general has said.

Attorney General Mike McGrath told the state Land Board on Monday that although settlement negotiations with Avista Corp. and PPL Montana LLC have so far been unsuccessful, rulings deeming the disputed streambeds public school trust lands have strengthened the state's case.
