11th Circ. Lets Home Depot Off Hook In Warning Label Dispute

Law360, New York (June 28, 2012, 7:39 PM EDT) -- The Eleventh Circuit has rejected a Spanish-speaking woman's product liability lawsuit blaming The Home Depot Inc. and manufacturer Enerco Group Inc. for a house fire caused by a space heater, saying English-language product warnings were enough to shield the companies from liability.

The appeals court said June 21 that it had no evidence that the retailer or manufacturer was seeking out Spanish-speaking customers like the Florida-based plaintiff, and upheld rulings under Florida law that English-packaging alone is sufficient.
