Federal Circuit Vacates MEMC Invalidity Ruling

Law360, New York (September 20, 2007, 12:00 AM EDT) -- In the latest twist in MEMC Electronic Materials Inc.’s patent suit, a federal appeals court on Thursday vacated a lower court’s ruling that MEMC’s patent covering a silicon wafer production method was invalid, but upheld a ruling that the company’s rivals did not infringe the technology.

Finding that questions remained over the issue of enablement, the U.S. Court of Appeals for the Federal Circuit on Thursday scrapped the trial court’s summary judgment holding that the Missouri-based company’s patent was invalid due to lack of enablement....
