J&J, Boston Scientific Trade Barbs At Opening Of Trial

Law360, New York (June 13, 2005, 12:00 AM EDT) -- Johnson & Johnson Inc. sued Boston Scientific Corp. for patent infringement lawsuit because the company is being beaten in the market for cardiovascular stents, a lawyer for Boston Scientific told the jury at the opening of a closely watched trial Monday.

“This case isn't about patent infringement,” Kirkland & Ellis partner John Desmarais, who represents Boston Scientific, told jurors. “'This case is about market share.”
