SMS Prevails Over Festo In Latest Chapter In Landmark Case

Law360, New York (June 17, 2005, 12:00 AM EDT) -- In the latest chapter in a landmark case that helped establish a key principle in U.S. patent law, a judge in the District of Massachusetts has found that SMC Corp. did not infringe Festo Corp.'s rodless cylinder.

The latest development in the 17-year-old dispute comes after the U.S. Supreme Court and the U.S. Court of Appeals for the Federal Circuit had established the law in the case, specifying when a patent owner could claim infringement under the doctrine of equivalents.
