Factory Mutual Wants $4.6M Ethanol Explosion Suit Tossed

Law360, New York (July 10, 2012, 5:26 PM EDT) -- Factory Mutual Insurance Co. on Monday asked a Nebraska federal judge to dismiss a construction company’s lawsuit claiming $4.6 million in damages from an accident at an ethanol plant, saying The Industrial Company Wyoming Inc. never had a policy with the insurer.

While Factory Mutual had issued two policies to another company, Pioneer Trail Energy LLC, which was involved in the construction of the ethanol plant in Wood River, Neb., it never issued one to TIC, the insurer said in a motion for summary judgment....
