Navistar Takes EPA Rumble Over Rivals' Engines To DC Circ.

Law360, New York (July 16, 2012, 7:51 PM EDT) -- Truck maker Navistar Inc. is aiming to resurrect its suit against the U.S. Environmental Protection Agency, telling the D.C. Circuit on Friday that the EPA had determined an emissions control system used by Navistar's rivals violated federal law and should have recalled the rivals' trucks.

The suit is an attempt to force the recall of several competitors' model year 2010 trucks, arguing that their diesel engines hadn't been properly tested for nitrogen oxide emissions.
