CWA Allows Revocation Of Permits, EPA Tells DC Circ.

Law360, New York (July 19, 2012, 5:33 PM EDT) -- The U.S. Environmental Protection Agency on Wednesday argued in the D.C. Circuit that it has the authority under the Clean Water Act to revoke Mingo Logan Coal Co.'s permit to discharge materials into two streams.

In a brief filed in the appeals court, the EPA asked for a reversal of a district judge's ruling that the agency had exceeded its authority under Section 404(c) of the CWA when it tried to invalidate a permit the U.S. Army Corps of Engineers already had issued.
