Alcon Sues Apotex To Block Vigamox Generic

Law360, Washington (July 23, 2012, 3:59 PM EDT) -- Alcon Pharmaceuticals Ltd. sued Apotex Inc. in Delaware federal court Friday, alleging the generic-drug maker's application to market a generic antibacterial eye drop infringes on two patents covering Alcon's blockbuster Vigamox.

Apotex informed Alcon on June 7 that it had filed an abbreviated new drug application with the U.S. Food and Drug Administration to produce and market a generic opthalmic drug containing moxifloxacin hydrochloride, which is primarily used to treat conjunctivitis, or “pink eye.”
