DOJ Antitrust Nominee Knocks Leegin At Confirmation Hearing

Law360, New York (July 26, 2012, 8:02 PM EDT) -- Arnold & Portner LLP's Bill Baer, the president's nominee to run the U.S. Department of Justice's antitrust unit, told lawmakers at his confirmation hearing Thursday that he supported reinstating a ban on retail price maintenance, saying the U.S. Supreme Court's Leegin decision created too much confusion for businesses.

Amid questions ranging from his general enforcement philosophy to his position on standard-essential patents, Baer told Sen. Herb Kohl, D-Wisc., that he would support legislation repealing the court's 2007 decision in the Leegin Creative Leather Products Inc. case,...
