Judge Likely To Toss Atty Suit Over Calif. Mortgage Fee Rule

Law360, Los Angeles (July 27, 2012, 9:28 PM EDT) -- A California judge on Friday tentatively dismissed an attorney's lawsuit challenging the constitutionality of a rule barring attorneys from collecting unbundled fees for handling home loan modifications after the state bar said the complaint is an attempt to sidestep disciplinary proceedings against the attorney.

Judge Joanne O'Donnell said in a tentative ruling that the court lacked jurisdiction to hear Swazi Elkanzi Taylor's complaint against The State Bar of California because it appears to be related to pending proceedings against the Los Angeles-based attorney. Taylor was found...
