FirstEnergy To Pay Fines, Close Ash Disposal Site

Law360, New York (July 30, 2012, 4:34 PM EDT) -- FirstEnergy Generation Corp. on Friday agreed to pay penalties of $800,000 and shut down a controversial coal ash disposal site in southwest Pennsylvania, resolving allegations by environmental regulators and advocacy groups of groundwater contamination.

The settlement deal with the Pennsylvania Department of Environmental Protection, filed in conjunction with a federal lawsuit in Pittsburgh, put to rest claims that FirstEnergy had violated the state’s Solid Waste Management Act and the U.S. Resource Conservation and Recovery Act by failing to address potential groundwater contamination at the site....
