Fed. Circ. Blocks Courts From Fixing Overbroad Use Codes

Law360, New York (July 30, 2012, 9:39 PM EDT) -- When a branded drug company is found to have listed a use code for a product that overstates the scope of a patent, courts cannot order specific changes the company must make to rectify the problem, the Federal Circuit held Monday in a ruling attorneys said clarified a recent U.S. Supreme Court decision.
