NLRB Broadens Striker Replacement Options

Law360, New York (October 2, 2007, 12:00 AM EDT) -- The National Labor Relations Board has junked a long-standing precedent for gauging whether workers hired to replace strikers were hired as permanent replacements, and has thereby made it easier for employers to refuse to let strikers keep their jobs.

With its Thursday decision, the board found that Jones Plastic & Engineering Co.'s Camden, Tenn. factory had explicitly hired the workers it brought in to replace strikers permanently; it pointed to forms the new hires signed and statements by human resources staff members that mentioned the permanent...
