Groups Buck Corps' Treated Wood Ban In Ore., Alaska Waters

Law360, New York (July 30, 2012, 8:02 PM EDT) -- A group of trade associations representing treated wood manufacturers, distributors and suppliers on Monday said the U.S. Army Corps of Engineers failed to properly notify the public when it prohibited treated wood in the waters of Alaska and Oregon.

The Western Wood Preservers Institute, Treated Wood Council, Railway Tie Association, Southern Pressure Treaters’ Association and Creosote Council also say the corps acted arbitrarily and capriciously when it approved the two conditional permits for the states by not following the proper process.
