A Guide To Inter Partes Review

Law360, New York (August 10, 2012, 12:48 PM EDT) -- On Sept. 16, 2012, the new inter partes review procedures will take effect at the U.S. Patent and Trademark Office. IPRs will differ significantly from current inter partes re-examination proceedings. IPRs will have the character of a district court bench trial on the issue of validity, albeit held before the USPTO. IPRs will feature discovery between the parties and culminate in a “trial” before the newly formed Patent Trial and Appeal Board.
