NLRB Slams Hospital's HR Confidentiality Rule

Law360, New York (July 31, 2012, 10:56 PM EDT) -- The National Labor Relations Board ruled Monday that an Arizona hospital human relations consultant's practice of asking employees making complaints not to discuss them with their co-workers while the employer conducted an investigation violated federal labor law.

In a 2-1 decision that partially reversed an administrative law judge's decision, the NLRB held that an HR consultant's routine practice of asking for such confidentiality from employees at Banner Estrella Medical Center ran afoul of the National Labor Relations Act.
