Deutsche Bahn Cartel Claims Filed In Time, UK Court Says

Law360, New York (July 31, 2012, 8:35 PM EDT) -- A U.K. appeals court said Tuesday that German rail company Deutsche Bahn AG's cartel suit against Morgan Crucible Co. PLC was not time-barred, reversing an earlier decision by the country's competition appeals tribunal and reinstating the case.

The Court of Appeal of England and Wales overturned a May 2011 dismissal ruling from the Competition Appeal Tribunal of the U.K. that found Deutsche Bahn's suit — which stems from Morgan Crucible's alleged role in an 11-year cartel on carbon and graphite products often used by rail companies...
