Ex-Ind. Utility Chief Can't Escape Misconduct Charges

Law360, New York (July 31, 2012, 9:02 PM EDT) -- An Indiana judge on Monday rejected a bid by the former chairman of the Indiana Utility Regulatory Commission to dismiss official misconduct charges against him over his alleged role in the unlawful conduct of the commission's former counsel in cases involving Duke Energy Corp.

After Judge Jim Osborne rejected David Lott Hardy's April motion to dismiss on Monday, Hardy will file an interlocutory appeal before his case proceeds to trial in October, his attorney confirmed Tuesday, declining to comment further.
