IBM Dodges Bankrupt Computer Reseller's Antitrust Suit

Law360, New York (August 1, 2012, 1:52 PM EDT) -- A Florida federal judge on Tuesday threw out computer reseller QSGI Inc.’s antitrust suit that alleged IBM Corp.’s monopolistic behavior drove it into bankruptcy, finding that while QSGI pled harm to itself, it failed to plead harm to competition in general.

U.S. District Judge Kenneth L. Ryskamp ruled QSGI failed to establish antitrust injury under Florida’s Antitrust Act of 1980 or the Florida Deceptive and Unfair Trade Practices Act and ordered the case dismissed with prejudice.
