Kyphon Wins Patent Suit Over Spine-Fracture Treatment

Law360, New York (July 6, 2005, 12:00 AM EDT) -- A Delaware jury has found that medical device maker Disc-O-Tech infringed a patent held by rival Kyphon, Inc. for the treatment of spine fractures caused by osteoporosis.

Kyphon originally sued Disc-O-Tech Medical Technologies, Ltd. and Disc Orthopaedic Technologies, Inc. for infringement of six Kyphon patents.

Earlier in the litigation process, Disc-O-Tech stipulated to infringement of two patents; Kyphon received summary judgment of infringement of two others; and Kyphon withdrew a fifth. Trial proceeded on the remaining patent.
