Marathon Price-Gouging Suit Sent Back To Ky.

Law360, New York (October 4, 2007, 12:00 AM EDT) -- An $89 million lawsuit brought by Kentucky’s attorney general against Marathon Oil Corp. will go back to state court after a judge dismissed a bid by the energy company to defend itself in a federal venue.

In rejecting Marathon’s calls for removal of the case, which accuses the company of raising fuel prices in the wake of Hurricane Katrina, U.S. District Judge Karen Caldwell said Wednesday that Kentucky’s laws specifically authorized the state’s top prosecutor to bring the action on behalf of the Commonwealth.
