Sanofi Sues Mylan Over Prostate Drug — Again

Law360 (October 8, 2007, 12:00 AM EDT) -- Weeks after it sued Mylan Pharmaceuticals Inc. and a slew of other generics in a Delaware district court over the patents for prostate treatment Uroxatral, Sanofi-Aventis filed another such complaint against Mylan in West Virginia federal court on Friday, in order to avoid risking an automatic 30-month stay of approval for a generic version of its drug.

Gerald Flattman of Kirkland & Ellis LLP, which is representing Sanofi, explained that his client had reason to believe that Morgantown, W.V.-based Mylan might challenge the Delaware jurisdiction....
