Injury Benefits Time-Barred In Flu Vaccine Suit: Fed Circ.

Law360, New York (August 10, 2012, 6:51 PM EDT) -- The Federal Circuit on Friday upheld a lower court’s decision denying injury compensation to the estate of a woman who allegedly died because of complications from an influenza vaccine, saying the Vaccine Act entitled her husband to death benefits but the statute of limitations barred his claim for injury benefits.
