CIT Says Sears' Bid To Reclassify Boots Misses Time Limit

Law360, New York (August 13, 2012, 7:15 PM EDT) -- The U.S. Court of International Trade on Friday tossed a challenge by Sears Holdings Management Corp. that claims that U.S. Customs and Border Protection misclassified certain imports of its footwear, saying that Sears didn’t bring its action within the proper amount of time.

CIT Judge Leo M. Gordon ruled that since Sears failed to bring its suit within 180 days of a protest decision by Customs, the court doesn’t have jurisdiction to hear the case, the opinion said.
