Fed. Circ. Revives Jury Verdict In Wake Forest Patent Suit

Law360, New York (August 13, 2012, 8:54 PM EDT) -- The Federal Circuit on Monday reinstated a jury's finding that Smith & Nephew Inc. infringed Wake Forest University's patented wound-healing technology, saying in a precedential decision that the district court should have been more deferential to the jurors' conclusion that the patents were valid.

The appeals court said U.S. District Judge W. Royal Ferguson erred in declaring the two Wake Forest patents obvious, saying he should have accepted all of the jury's factual findings unless they were completely unsupported by evidence.
