Nursing Homes Can't Skirt Reporting Rules, 3rd Circ. Says

Law360, New York (August 15, 2012, 2:20 PM EDT) -- The Third Circuit ruled Tuesday that nursing homes can’t escape disclosure requirements under a provision of the Federal Nursing Home Reform Amendments that allows the quality assurance committees of these facilities to keep committee records private.

The nursing home in question, the Jewish Home of Eastern Pennsylvania, was attempting to fight fines it incurred in 2005 and 2006 related to Medicare that were imposed after inspectors viewed patient incident reports and other medical records.
