Enviros' Challenge To Pa. Gas Facility Emissions Advances

Law360, Philadelphia (August 15, 2012, 6:43 PM EDT) -- The Pennsylvania Environmental Hearing Board allowed an environmental advocacy nonprofit’s challenge to a Laurel Mountain Midstream LLC gas collection facility's emissions plan to move forward Tuesday, dismissing the company’s efforts to preempt the challenge.

In Tuesday’s ruling, the board concluded that Laurel Mountain’s Shamrock Compressor Station met one of the Clean Air Act's criteria for assessing pollution as coming from a single source, finding that the other two criteria for aggregation could not be considered without a full hearing.
