Nurses Can Be Experts In Standard Of Care Suits: Ind. Court

Law360, New York (August 16, 2012, 2:25 PM EDT) -- An Indiana appeals court on Wednesday upheld the dismissal of a wrongful-death suit filed against a nursing home by the dead patient’s son, but refused to establish a blanket rule barring nurses from being expert witnesses in suits over breaches of medical care standards.

The state’s Court of Appeals said that under Indiana’s rules of evidence, nurses can testify as expert witnesses in cases involving standards of medical care and as to whether an alleged breach caused an injury, provided they have sufficient expertise.
