FTC Halts Mouthguard Co.'s Concussion Prevention Claims

Law360, New York (August 16, 2012, 7:03 PM EDT) -- The U.S. Federal Trade Commission on Thursday said mouthguard marketer Brain-Pad Inc. is now barred from making unsupported claims that its mouthguards reduce the risk of concussions, as part of a settlement closely watched by Congress.

As part of the FTC’s ongoing efforts to protect consumers from over-hyped health claims, the agency said the settlement also prohibits Brain-Pad and company president Joseph Manzo from misrepresenting the health benefits of any mouthguard or other athletic equipment designed to protect the brain from injury.
