Blue Cross Denied Document Request In Mich. Antitrust Case

Law360, New York (August 16, 2012, 7:33 PM EDT) -- A federal judge Wednesday blocked a Blue Cross Blue Shield of Michigan subpoena seeking hospital documents in an antitrust case, calling the request overbroad in a setback to the insurer’s efforts to show it hasn’t stifled competition with most-favored-nation clauses in contracts with hospitals.

Blue Cross is facing a U.S. Department of Justice lawsuit that says the clauses have made the company effectively immune from competition by guaranteeing other health insurers can’t secure better rates, likely raising prices on health care services and insurance.
