Haynes & Boone Blames Rx.com For Antitrust Suit's Late Filing

Law360, Houston (August 20, 2012, 11:09 PM EDT) -- A Haynes & Boone LLP attorney testifying in a malpractice case claiming the firm waited too long to file an antitrust suit blamed the client in Texas court Monday, saying defunct Internet pharmacy Rx.com's founder waited to pursue the case to avoid involving a court-appointed receiver.

Firm partner Patrick Hughes said Rx.com founder Joe Rosson did not want a receiver who was managing the company to know about the antitrust claim, creating a barrier to filing the suit before the statute of limitations expired.
