Law360, New York (August 22, 2012, 6:46 PM EDT) -- The U.S. Department of Justice insisted Tuesday in the Eleventh Circuit that a state-owned company qualifies as an “instrumentality of a foreign government” under the Foreign Corrupt Practices Act, defending its contested definition before appellate review for the first time.
