Device Co. Sues Over $6M Loss After Tainted Mouthwash Recall

Law360, New York (August 22, 2012, 6:41 PM EDT) -- Medical device maker Trademark Medical LLC sued Birchwood Laboratories Inc. on Monday in Missouri court, saying it suffered nearly $6 million in losses after several users of its Plak-Vac Oral Care System contracted a bacterial infection that was traced back to tainted mouthwash supplied by Birchwood.

Trademark says that shoddy quality control at a Birchwood facility resulted in the shipment of packaged mouthwash contaminated with Burkholderia cepacia bacteria and that after that mouthwash sickened users of Trademark’s Plak-Vac suction brushes, the company was forced to issue...
