Wyeth Asks Pa. High Court To Drop $8.6M Prempro Punitives

Law360, Philadelphia (September 11, 2012, 4:02 PM EDT) -- Pfizer Inc. unit Wyeth Pharmaceuticals Inc. on Tuesday asked the Pennsylvania Supreme Court to overturn an $8.6 million punitive damages award over the company’s Prempro menopause drug, arguing that it was invalidated by the U.S. Food and Drug Administration’s approval of the drug.

Wyeth contends that the appeals court erred in reinstating the award originally granted in 2007 by a Philadelphia jury to Mary Daniel, an Arkansas woman who claimed that the drug caused her breast cancer.
