Patent Group Attacks Nike's Bid For 'Undeserved' IP Rights

Law360, New York (August 27, 2012, 6:11 PM EDT) -- Allowing Nike Inc. to invoke a covenant not to sue to head off a rival's challenge to the validity of its sneaker trademark will boost “undeserved” intellectual property rights while weakening the intellectual property system itself, the Public Patent Foundation told the U.S. Supreme Court on Thursday.

The intellectual property rights advocacy group argued that shoe maker Already LLC, which does business as Yums, must prevail in its appeal of the Second Circuit's ruling in November that the company can no longer assert counterclaims of invalidity...
