Law360, New York (October 12, 2007, 12:00 AM EDT) -- Government action against the major drug companies over an alleged Medicare scam remains mired in a battle for documents, with pharmaceutical giant Abbott Laboratories Inc. demanding U.S. officials produce records explaining the rationale for relying on the industry's own prices.

The drug manufacturer has urged the Massachusetts judge overseeing the multidistrict litigation over the industry's average wholesale drug prices to compel the government to turn over documents detailing its decision to adopt, and keep, the reported prices as the basis for Medicare rebates on prescription medication....
