E-Discovery Plays Greater Role In Cases: Survey

Law360, New York (October 12, 2007, 12:00 AM EDT) -- Companies are ratcheting up their data retention policies as voice mail, instant messages and other technologies play an ever-increasing role in discovery, according to a new study by Fulbright & Jaworski LLP.

In its fourth annual Litigation Trends survey, Fulbright & Jaworski interviewed in-house counsel at 253 major U.S. corporations and 50 U.K. corporations. Overall, the firm found that 54% of companies allowed instant messages in their workplace and that 31% of companies retained those IMs.
