Rx.com Had A Solid Antitrust Case, Ex-DOJ Atty Says

Law360, New York (August 29, 2012, 9:37 PM EDT) -- A defunct Internet pharmacy had a strong antitrust claim before Haynes and Boone LLP missed the filing deadline for a lawsuit, a former U.S. Department of Justice attorney testified Wednesday at the firm’s malpractice trial in Texas state court.

David A. Balto, a former DOJ antitrust trial attorney who also served as policy director of the Federal Trade Commission’s Bureau of Competition, told jurors that collusion by pharmacy benefit managers to exclude Rx.com from their benefits networks would be “totally illegal” under federal antitrust statutes....
