Apotex, Lupin Hit With Suit Over Generic Arthritis Drug

Law360, New York (August 31, 2012, 2:19 PM EDT) -- Nuvo Research Inc. and Mallinckrodt LLC sued generic-drug makers Apotex Inc. and Lupin Pharmaceuticals Inc. in Delaware federal court on Thursday to block them from releasing their own version of arthritis pain cream Pennsaid.

Nuvo and exclusive licensee Mallinckrodt accused Apotex and Lupin of infringing its patent for Pennsaid by filing an abbreviated new drug application with the U.S. Food and Drug Administration for a topical solution containing 1.5 percent diclofenac sodium, the nonsteroidal anti-inflammatory drug in the pain treatment.
