Haynes And Boone Could Have Won Fumbled Case: Witness

Law360, Houston (September 4, 2012, 8:43 PM EDT) -- A failed Internet pharmacy likely would have won an antitrust suit it was pursuing before the filing deadline was missed, a former Department of Justice division chief testified Tuesday at Haynes And Boone’s malpractice trial in Texas state court.

Donald Baker, who served as assistant attorney general in charge of the DOJ’s antitrust division, said he felt confident that had its case made it to trial, Rx.com would have convinced jurors that pharmacy benefits managers violated federal antitrust law.
